1. Binding Offers and Good Faith Negotiations

All offers and counter-offers made via DomainTech are legally binding during the negotiation process and must be conducted in good faith. Agreements are binding through the completion of the transaction.

2. Service and Escrow Fees

Agreements reached via DomainTech are subject to a service fee, starting at 10% and decreasing based on agreement size. Unless otherwise stated by DomainTech, the service fee and associated escrow fees are the responsibility of the domain buyer.

3. Offer Presentation Guarantee

If DomainTech cannot present the buyer's offer to the domain owner for any reason, DomainTech will provide the buyer with a complimentary DomainTech credit, usable for a subsequent offer.

4. Completion of Services

DomainTech service is considered fully delivered upon presentation of the buyer's initial offer.

5. Valuation Estimates

Any valuation estimate provided or implied by DomainTech is based on current market information and should be used as a guideline only. DomainTech cannot guarantee these valuation estimates.

6. Legal Rights Representation

The buyer confirms that neither they nor their organization claims a legal right to the registration of the domain they seek to acquire. If representing another party, the buyer guarantees they are authorized to make this representation.

7. Transaction Completion

Unless otherwise communicated by DomainTech, all transactions initiated using DomainTech will be completed via Escrow.com.

8. Consequences for Buyer's Reneging

In the event a buyer reneges on a purchase agreement, full transaction details, including buyer identity, will be disclosed to the seller and may be made public. The buyer will be responsible for the full 10% transactional fees due to DomainTech.

9. Penalties for Seller's Reneging

Should the seller renege on an agreement, they will be liable for a penalty fee equivalent to 10% of the agreed transaction value, payable to DomainTech, and any additional damages incurred by the buyer due to the reneging.

10. Circumvention and Legal Action

Any attempt to circumvent these terms may result in legal action, forfeiture of DomainTech credits, and account suspension.

11. Disclaimer

DomainTech acts as an intermediary and cannot be held responsible for the actions of either party beyond the services provided.

12. Modification of Terms

DomainTech reserves the right to modify these terms and conditions at any time, with changes becoming effective upon posting on the DomainTech website.

13. Governing Law

These terms and conditions shall be governed by and construed in accordance with the laws of Canada where DomainTech is registered.
